2. Terms of sale

What you are buying

OhMyRAW is downloadable software. Buying it grants you a perpetual licence to use the application on the terms set out in section 3. You are not buying the software itself, and no ownership of the software passes to you.

Price and payment

Prices are shown in euro and include VAT where it applies. The price shown at the moment you complete your purchase is the price that applies; introductory pricing may end at any time, and a price change never affects a licence already bought.

Payments are processed by Lemon Squeezy, who acts as merchant of record for the transaction, charges any VAT due and issues your receipt. Their terms apply to the payment itself; these terms apply to the software.

Delivery

Your licence key and download link are sent to the email address you give at checkout, normally within a few minutes and always within 24 hours. If nothing arrives, check your spam folder and then write to us — we will resend it.

System requirements

OhMyRAW runs on macOS, Linux and Windows, on Intel, Apple silicon and ARM. Current minimum versions and hardware requirements are stated on the download page. Please check them before buying: the software will not run on unsupported systems.

If something is wrong

If the software has a fault, you have the rights given to you by the Swedish Consumer Sales Act (konsumentköplagen) and, if you are in the EU, by EU consumer law. Nothing in these terms limits those rights. Write to us first — most problems are faster to fix than to argue about.

Governing law and disputes

Swedish law applies. If you are a consumer, you keep the protection of any mandatory rules of the country you live in, and you may bring a dispute before the Swedish National Board for Consumer Disputes (Allmänna reklamationsnämnden, arn.se) or use the EU's online dispute resolution platform. We follow ARN's recommendations.

3. Licence terms

The licence

Technest AB grants you a perpetual, worldwide, non-exclusive licence to install and use OhMyRAW. It does not expire, and it does not depend on a subscription or an account.

What it covers

Replacing a machine doesn't cost you a slot. Deactivate the old one in OhMyRAW if you still have it, or write to us and we'll free it for you.

What it does not cover

Updates

Free updates for life means this: every update we release for OhMyRAW is included in the price you paid, for as long as we go on developing and selling it. It is not a promise that any particular feature will be built, nor that development continues indefinitely. If OhMyRAW is ever discontinued, your licence and the last version you received keep working — there is no server that switches them off.

Your files

OhMyRAW is non-destructive and stores your edits in an ordinary folder on your own disks. Your photographs, your edits and your library remain yours entirely, and they stay readable whether or not the software is still supported.

Transferring the licence

A licence may be transferred once to another person — for example when you sell the computer it lives on — provided you keep no copy and tell us the new owner's email so we can reassign the key. TODO — confirm you want this

Warranty and liability

OhMyRAW is provided as it is. Beyond the statutory rights described in section 2, we make no further warranty that it is free of defects or fit for a particular purpose. To the extent the law allows, Technest AB's total liability arising from the software is limited to the amount you paid for your licence. Nothing here limits liability for death, personal injury, fraud, or anything else that cannot lawfully be limited.

Please keep your own backups. OhMyRAW never modifies your original files, but no software is a substitute for a backup, and we cannot be responsible for data you have not copied elsewhere.

Ending the licence

Your licence ends if you materially breach these terms — for example by redistributing the software — and do not put it right within 30 days of us asking you to. Otherwise it does not end.

4. Refunds and the right of withdrawal

Fourteen days, no reason needed

If you are a consumer in the EU or the EEA, you have 14 days from the day of purchase to withdraw from the sale and get your money back. You do not have to explain why, and we do not ask.

Ordinarily this right can be waived for software delivered immediately. We do not ask you to waive it. OhMyRAW has no time-limited trial, so the withdrawal period is how you try it: buy it, use it on your own photographs for two weeks, and if it is not the developer you want, ask for your money back.

How to withdraw

Write to the email address in section 1, from the address you bought with, within 14 days. A sentence is enough. You may use the model withdrawal form in the Consumer Rights Directive, but you do not have to.

We refund to the original payment method, normally within a few days and always within 14 days of receiving your notice. When you withdraw, your licence ends and you should uninstall the software.

After the 14 days

The statutory right ends, but your rights over a faulty product do not. If OhMyRAW does not do what it is sold as doing, write to us — we would rather fix it or refund you than have you keep software you cannot use.

Business purchases

The statutory right of withdrawal applies to consumers. If you bought as a business, the same 14-day practice is offered as a matter of policy rather than obligation.

5. Privacy

Technest AB, identified in section 1, is the data controller for the personal data described here. In short: the application collects nothing, and the company keeps only what is needed to sell you a licence.

The application

OhMyRAW has no account, no telemetry and no analytics. It does not report what you edit, how often you open it, or that it has been opened at all. Your photographs and your library never leave your computer through us.

Apart from the licence check described below, the application makes exactly one outbound connection, and only when you ask it to: pressing Download lens profiles fetches the open lens-profile database from GitHub. That request goes to GitHub, not to us, and carries nothing about you beyond what any download does.

If you choose to sync your library between your own devices, that runs through a folder synchronised by a provider you have chosen — iCloud Drive, Dropbox, Google Drive, OneDrive, Syncthing or another. Your files go to that provider under their terms. They do not pass through any server of ours.

Activating your licence

There is no account and no sign-in. You type your licence key into the app once, and OhMyRAW checks it with Keygen — the service that issues and validates our keys — then remembers the answer on your device.

That happens at activation and not again. OhMyRAW does not check in when you open it, and it does not need an internet connection to run. The one check carries your key and a fingerprint of the machine, enough to count how many devices a licence is installed on, and nothing whatsoever about your photographs.

Buying a licence

To sell you a licence we process your email address, your licence key, and the country and VAT status needed to charge the right tax. Payment card details are handled by our payment provider and never reach us.

Support email

If you write to us, we keep the correspondence for as long as it is useful for supporting you, and no longer.

This website

Every page except the checkout sets no cookies, runs no analytics or tracking scripts, and loads nothing from a third party. Even the typefaces are served from this site rather than from Google Fonts, so reading about OhMyRAW tells no one but our own host that you were here.

The checkout page is the single exception, and only while you are on it. It loads Stripe's payment library so your card details can go straight to Stripe without ever passing through us; Stripe sets its own cookies there and collects the technical signals it needs to detect fraud, under their privacy policy. Nothing of the sort runs anywhere else on the site.

Your rights

You may ask for a copy of the personal data we hold about you, ask us to correct or erase it, object to or restrict processing, or receive it in a portable form. Write to the address in section 1 and we will answer within a month. If you think we have handled your data wrongly, you may complain to the Swedish Authority for Privacy Protection (Integritetsskyddsmyndigheten, imy.se).

Transfers outside the EU

Lemon Squeezy and Keygen are based in the United States and process the data described above there, under the safeguards in Chapter V GDPR. TODO — confirm each provider's current transfer mechanism (SCCs / Data Privacy Framework) and keep their DPAs on file
